In September 2021, Hilliard Law attorneys secured a $50 Million settlement for the family of a man who sustained serious injuries in a commercial trucking accident. The father of four was preparing to take a left-hand turn when an 18-wheeler attempted to pass him in a no-passing zone, striking the rear of his car, causing it to burst into flames. The decedent suffered extensive burns and was paralyzed due to neck injuries. He was hospitalized for 4-months and passed away due to complications from his injuries after being sent home.

CORPORATE MALPRACTICE VERDICT
Mr. Hilliard was also the lead class counsel in Haese v. H&R Block, a class action lawsuit involving every Texan who received a rapid refund from H&R Block (approx. 300,000 plaintiffs). He assisted other class counsel in forcing H&R Block to disclose it received kickbacks for arranging loans between its tax preparation clients and predatory lenders. The settlement for his clients was over $50 million.

AUTOMOTIVE VERDICT - DISTRACTED DRIVING
Mr. Hilliard was the lead trial attorney in a case involving a woman who was injured in a two-vehicle accident. The driver of the second car, an employee for Coca-Cola, was talking on her cell phone at the time of the accident. That verdict was the largest 2012 jury verdict in the nation for a case involving a back injury requiring surgery. It was also the third largest motor vehicle verdict in Texas for 2012 and ranked No. 11 in overall verdicts in Texas for 2012.

In May 2013, Mr. Hilliard was the lead trial attorney who obtained a $25 million jury verdict in a premises liability case in Nueces County, Texas. His client, a security guard for a downtown Corpus Christi building, was severely beaten while at work. The $25 million judgment is the 2013 No. 1 verdict in Texas for a premises liability case.

PREMISES LIABILITY VERDICT
After only 3 days of trial, a San Patricio County, Texas jury returned a returned a record breaking $18 million verdict, including $10 million in punitive damages, on behalf of our client, the widow of a trucker and handyman, who died after falling through a roof. His employer, I&R Trucking, had asked him to replace a rooftop skylight despite having knowledge of hazardous conditions. I&R Trucking willfully failed to provide Mr. Perez with any fall protection training, instruction, or equipment. In a notoriously conservative county, the jury unanimously agreed that I&R Trucking was grossly negligent for its callous disregard of the safety and welfare of its employee. This verdict remains the single largest wrongful death verdict in a premises liability case in the history of San Patricio County, Texas.

In 2005, Mr. Hilliard represented multiple plaintiffs in litigation with Ocwen Loan Services, LLC (formerly Ocwen Federal Savings Bank) on allegations of predatory lending. Mr. Hilliard tried two cases which resulted in combined verdicts of $13.5 million. Mr. Hilliard’s firm was then appointed Liaison Counsel in the Ocwen Multi-District Litigation in Texas.

A jury awarded $10.9 to the families of the victims. Bob Hilliard’s huge victory in Trice, et. al v. Toyota Motor Corporation, et. al is the largest U.S. verdict related to death and injury caused by sudden acceleration of Toyota vehicles.

Our client, a Service Transport commercial truck driver, sustained catastrophic injuries from a fall while making a delivery at BASF’s chemical facility. He subsequently passed away from those injuries. The jury found that BASF was negligent in failing to provide adequate safety policies and procedures. Further, based on previous similar incidents, BASF knew or should have known of the dangers. The jury agreed, finding BASF 100% at fault.

Mr. Hilliard was Lead Counsel in the pharmaceutical product liability case against Johnson & Johnson based on allegations that its drug, Risperdal, was promoted for uses not approved by the FDA and for payment of kickbacks to physicians for prescribing the medication. Mr. Hilliard led the negotiations and successfully settled over 1,500 cases for a confidential amount after he took the deposition of Johnson & Johnson’s CEO, Alex Gorsky.

SOCIAL JUSTICE SETTLEMENT
Hilliard Law attorneys secured a large confidential settlement against a financial institution that imposed unjust and discriminatory standards on its Black customers. The sizeable settlement marked a victory against the widespread, racist phenomenon known as “Banking while Black.” The settlement not only provided a monetary award to the victims of discrimination, it also required the bank to set aside funds for African American community advancement.
