While they are obviously wrong acts, neglect can be harder to spot, especially when it is prompted, not by malice, but by issues like understaffing or lack of training. Nonetheless, it is still negligence and when it causes injury, residents may have grounds for a case.
Bedsores, infections, or unsanitary conditions are not excused by good intentions. Nursing homes have a duty to provide humane, safe, reasonable care to their residents, respecting their dignity and privacy. Failure to uphold that duty violates the law.
Texas allows victims to seek compensation through a civil lawsuit. However, taking legal action can be confusing when criminal charges are also levied against a nursing home or caregiver, such as for assault.
